1. Introduction
Welcome to Mont du Kwai Resort (“we,” “our,” or “us”). These Terms and Conditions govern your access to and use of our website, booking services, and resort facilities. By accessing our website, making a reservation, or using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Definitions
- “Resort” refers to Mont du Kwai Resort, located in Kanchanaburi, Thailand.
- “Guest,” “you,” or “your” refers to the individual making a reservation or staying at the Resort.
- “Booking” or “Reservation” refers to the arrangement of accommodation at the Resort.
- “Website” refers to the official Mont du Kwai Resort website.
3. Reservations and Bookings
3.1 Reservation Process
- Reservations can be made through our website, by email, by telephone, or through authorized third-party booking channels.
- All reservations are subject to availability.
- A reservation is only confirmed upon receipt of a confirmation email or letter from the Resort.
- The Resort reserves the right to refuse any booking for any reason.
3.2 Required Information
- To make a reservation, you must provide accurate and complete information including:
- Full name
- Contact information (phone number and email address)
- Valid credit card details for guarantee purposes
- Arrival and departure dates
- Number of guests
3.3 Rates and Charges
- All rates are quoted in Thai Baht (THB) and include applicable government taxes and service charges.
- Rates are subject to change without notice unless a reservation has been confirmed.
- Special promotional rates may be subject to different terms and conditions as specified in the offer.
- Additional charges may apply for extra services, amenities, or facilities not included in the room rate.
4. Payment Policy
4.1 Deposit
- A deposit may be required to secure your reservation, as specified at the time of booking.
- For certain periods or special promotions, full prepayment may be required.
4.2 Payment Methods
- We accept major credit cards including Visa, MasterCard, American Express, and JCB.
- Bank transfers may be accepted for group bookings or event reservations.
- Cash payments are accepted in Thai Baht (THB) only.
4.3 Settlement of Account
- Full payment for accommodation and incidental charges is required upon check-out.
- For extended stays, the Resort may request periodic settlement of accounts.
5. Cancellation and Modification Policy
5.1 Cancellation
- Standard Reservations: Cancellations made at least 7 days prior to the arrival date will receive a full refund of any deposit paid.
- Cancellations made 3-6 days prior to arrival will incur a charge equivalent to one night’s stay.
- Cancellations made less than 3 days prior to arrival or no-shows will incur a charge equivalent to the full stay.
- Peak Season Reservations (December 20 – January 10, Thai New Year, and other specified holiday periods): Cancellations made less than 14 days prior to arrival will incur a charge equivalent to the full stay.
5.2 Modification
- Modifications to existing reservations are subject to availability.
- Changes to arrival or departure dates may result in rate changes or cancellation fees.
- The Resort reserves the right to treat significant modifications as a cancellation and new reservation.
5.3 Early Departure
- Guests departing prior to their scheduled check-out date will be charged for the remaining nights of their original reservation.
6. Check-In and Check-Out
6.1 Check-In Time
- Standard check-in time is 2:00 PM.
- Early check-in is subject to availability and may incur additional charges.
6.2 Check-Out Time
- Standard check-out time is 12:00 PM.
- Late check-out requests are subject to availability and may incur additional charges.
- Late check-out beyond 6:00 PM will be charged as an additional night’s stay.
6.3 Identification Requirements
- All guests must present valid identification (passport for international guests, Thai ID card for Thai nationals) upon check-in.
- The Resort reserves the right to refuse accommodation to guests who cannot provide valid identification.
7. Resort Policies
7.1 Guest Conduct
- Guests shall conduct themselves in a manner that respects the comfort and safety of other guests and staff.
- Excessive noise, disruptive behavior, or any activity that may disturb other guests is prohibited.
- The Resort reserves the right to refuse or terminate accommodation without refund for guests who violate this policy.
7.2 Damage to Property
- Guests will be held responsible for any damage to Resort property caused by them, their visitors, or any person for whom they are responsible.
- The cost of any damage will be charged to the guest’s account.
7.3 Smoking Policy
- Mont du Kwai Resort is a non-smoking property. Smoking is only permitted in designated outdoor areas.
- A cleaning fee of THB 5,000 will be charged for smoking in non-designated areas.
7.4 Pet Policy
- Pets are not allowed on the property, with the exception of certified service animals.
- Guests must notify the Resort in advance if they will be accompanied by a service animal.
7.5 Child Policy
- Children of all ages are welcome at the Resort.
- Children under 12 years of age stay free of charge when using existing bedding.
- Cribs and extra beds are available upon request and may incur additional charges.
8. Liability and Responsibility
8.1 Personal Belongings
- The Resort shall not be responsible for any loss or damage to guests’ personal belongings.
- Guests are advised to use in-room safes for valuables.
- Lost and found items will be kept for a maximum of 90 days, after which they will be disposed of.
8.2 Accidents and Injuries
- The Resort shall not be liable for any accident, injury, illness, or death suffered by guests while on the Resort premises, except to the extent that such liability cannot be excluded by law.
- Guests use Resort facilities, including swimming pools, fitness center, and recreational areas, at their own risk.
8.3 Force Majeure
- The Resort shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, strikes, or other labor disputes.
9. Privacy and Data Protection
- The Resort collects and processes personal information in accordance with its Privacy Policy.

10. Intellectual Property
- All content on the Resort’s website, including text, graphics, logos, images, audio clips, and software, is the property of the Resort or its content suppliers and is protected by international copyright laws.
- Unauthorized use of any materials from the Resort’s website may violate copyright, trademark, and other laws.
11. Governing Law and Jurisdiction
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand.
- Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Thailand.
12. Amendments to Terms and Conditions
- The Resort reserves the right to modify these Terms and Conditions at any time without prior notice.
- The current version of the Terms and Conditions will be available on the Resort’s website.
- Your continued use of our services after any changes to these Terms and Conditions constitutes your acceptance of the new terms.
13. Severability
- If any provision of these Terms and Conditions is found to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.
